Terms & Conditions

1. SERVICES PROVIDED 1.1. Just Right Boat Hauling, LLC (JRBH) agrees to transport Customer’s boat by trailer
or water as requested. 1.2. JRBH reserves the right to refuse service for any reason, including unsafe conditions.
1.3. JRBH will make reasonable efforts to transport the boat within the estimated timeframe but does not guarantee
specific delivery dates. 1.4. JRBH is not responsible for any delays caused by traffic, weather, mechanical failures,
or other unforeseen circumstances. 1.5. JRBH shall not be held liable for any failure to provide service due to force
majeure events as outlined in Section 7.

2. CUSTOMER RESPONSIBILITIES 2.1. Customer shall ensure that the boat is properly prepared for transport,
including securing all loose items, draining fluids as necessary, and protecting fragile parts. 2.2. Customer must
provide accurate information about the boat’s size, weight, condition, and any special handling requirements. 2.3.
Customer is responsible for obtaining any required permits, approvals, or escort services necessary for transport.
2.4. Customer must disclose any pre-existing damage or structural issues prior to transport. 2.5. If the boat is not
properly prepared for transport, JRBH reserves the right to refuse service or charge additional fees for necessary
adjustments. 2.6. Customer agrees to pay all fees associated with transportation, including but not limited to
additional fees incurred due to misrepresentation of the boat’s specifications or inadequate preparation.

3. ASSUMPTION OF RISK & WAIVER OF LIABILITY 3.1. Customer acknowledges that boat transport by trailer or
water involves inherent risks, including but not limited to damage, theft, mechanical failure, acts of nature, accidents,
and any unforeseen incidents beyond JRBH's control. 3.2. Customer voluntarily assumes all risks associated with
transport and agrees that JRBH shall not be liable for any loss, damage, personal injury, or death arising from or
related to the transport. 3.3. JRBH is not responsible for pre-existing damage, wear and tear, or damage caused by
third parties, road conditions, or weather events. 3.4. JRBH shall not be held liable for any damage caused by
improper boat preparation, including unsecured items or improperly balanced loads. 3.5. If the boat is being
transported on water, the Customer acknowledges and accepts the risks associated with navigational hazards,
mechanical failures, and adverse weather conditions. 3.6. Customer agrees that any legal claims against JRBH
must be brought within six (6) months of the transport date or shall be forever barred.

4. INDEMNIFICATION 4.1. Customer agrees to indemnify, defend, and hold harmless JRBH, its owners, employees,
agents, and contractors from any claims, lawsuits, damages, losses, or expenses arising from or related to the
transport of the boat, including but not limited to third-party claims.

5. LIMITATION OF LIABILITY 5.1. The maximum liability of JRBH for any claims arising under this Agreement shall
not exceed the total amount paid for transport services. 5.2. JRBH is not responsible for indirect, consequential,
punitive, or incidental damages, including but not limited to loss of use, loss of value, or loss of business revenue.

6. INSURANCE 6.1. Customer is responsible for obtaining adequate insurance coverage for their boat during
transport. 6.2. Customer waives any subrogation claims against JRBH by their insurer. 6.3. JRBH requires that the
customer provides an insurance policy that covers the customer AND JRBH for transportation-related risks prior to
service commencement, and provides a copy of said insurance to JRBH.

7. FORCE MAJEURE 7.1. JRBH is not liable for delays or failure to perform due to events beyond its control,
including but not limited to weather, road closures, mechanical failures, labor strikes, government regulations, or
acts of God. 7.2. If a force majeure event prevents the completion of transport, JRBH may reschedule or terminate
the Agreement without liability.

8. PAYMENT TERMS & NON-PAYMENT POLICY 8.1. Customer agrees to pay the full transport fee as agreed upon
before service is rendered. 8.2. A deposit may be required at the time of booking. The remaining balance is due
upon pickup of the boat unless otherwise agreed in writing. 8.3. If payment is not made in full (meaning JRBH has
payment irreversibly in its bank account) upon delivery, JRBH reserves the right to retain possession of the boat
until payment is received. 8.4. Any unpaid balances will accrue interest at the rate of 1.5% per month (or the maximum amount allowed by law) until paid in full. 8.5. If Customer fails to make full payment within 30 days, JRBH
may initiate legal action and seek reimbursement for all legal costs, collection fees, and associated expenses.

9. DISPUTE RESOLUTION 9.1. Any disputes arising from this Agreement shall be resolved through binding
arbitration in the state where JRBH is headquartered. 9.2. The prevailing party in any dispute resolution proceeding
shall be entitled to recover reasonable attorney’s fees and legal costs. 9.3. This Agreement does not waive JRBH’s
right to pursue claims for non-payment or breach of contract through legal action if necessary.

10. GOVERNING LAW 10.1. This Agreement shall be governed by and interpreted under the laws of the state in
which JRBH operates.

11. CANCELLATION POLICY 11.1. If the Customer cancels the transport service less than 48 hours before the
scheduled transport time, a cancellation fee of up to 50% of the agreed-upon price may apply. 11.2. If JRBH cancels
the transport due to unforeseen circumstances, the Customer will receive a full refund of any pre-paid amounts.

12. ENTIRE AGREEMENT 12.1. This Agreement constitutes the entire understanding between JRBH and the
Customer and supersedes all prior verbal or written agreements. 12.2. Any modifications to this Agreement must be
in writing and signed by both parties. 12.3 If any clause is determined invalid, the remainder of this Agreement
remains valid, in full force and effect.

13. ACKNOWLEDGMENT & AGREEMENT 13.1. By signing our quote form, putting a check on "I agree to the terms & conditions - View terms of Quote," Customer acknowledges to have read, to understand and to voluntarily agree to the terms of this Agreement.

14. BOAT PREPARATION ACKNOWLEDGMENT 14.1. Customer acknowledges that they have read and understood the Just Right Boat Hauling (JRBH) Boat Preparation Guide, which provides detailed instructions on how to properly prepare the boat for overland transportation. 14.2. Customer agrees to follow all guidelines and recommendations outlined in the Boat Preparation Guide to ensure the safe and secure transport of their boat. 14.3. Customer understands that JRBH shall not be held responsible for any damage caused by improper preparation, failure to comply with the guidelines, or issues arising from faulty equipment provided by the Customer or their agent. 14.4. By signing this Agreement, the Customer confirms that they have either personally overseen the preparation of the boat or entrusted it to a qualified professional and that the boat is ready for transport in compliance with JRBH's requirements.
